What is a Guardianship Power of Attorney? Parents can sign a letter of Guardianship Authorization that gives a family member or friend permission to care for and make medical and educational decisions for the child while the child is under their care. This letter of authorization acts like a power of attorney but does not give the caregiver any kind of official legal custody of the child. It also does not terminate or suspend a parent's legal rights. The letter of authorization provides recognition of a person's caregiver status to doctors, schools and other institutions of the informal arrangement. The authorization allows them to enroll the child in school, consent to necessary medical care and even apply for Medi-Cal or qualified benefits from the Social Security Administration.
What is a Guardianship Caregiver's Authorization? Under Family Code Sections 6550-6552, this form can be unilaterally signed by the person who has care and custody of the child. This form can be used in lieu of, or in addition to the Guardian Authorization Power of Attorney form. Schools and medical facilities are required by law to accept the Caregiver’s Authorization Affidavit, however only certain relatives are qualified to use this form. If the child will remain living in California, the person taking care of the child can complete and sign a Caregiver's Authorization Affidavit. Important terms and conditions of using this form are:

1) If the person caring for the child is a relative of the child, this form allows the relative caregiver to enroll the child in school. It also gives the relative caregiver the same rights as a guardian to get medical care, including mental health treatment, for the child. A list of the relatives that are qualified under this law are listed on the back of the affidavit.
2) If the person taking care of the child is NOT a relative, this form still lets the caregiver enroll the child in school, but they have limited authorization to make medical care decisions involving school (such as immunizations or physical exams required to enroll the child in school).
3) The Caregiver's Authorization Affidavit does not have to be signed by the parents, but the parents can cancel the affidavit at any time.
4) The affidavit is only valid during the time the child is living with the caregiver. The caregiver is required to tell the school and health care provider if the child is no longer living with them.
What is a Court Guardianship? There are many things that would be prohibited with an informal guardianship that would otherwise be allowed if a person had legal guardianship. An informal guardianship usually does not allow a person to place the minor child on their medical insurance policy. A non-parent caregiver cannot consent to a disability assessment or sign a child’s special education plan if the parent is still available to make the decision. Although an informal caregiver can enroll a child in school, the letter of authorization and affidavit does not specifically authorize the informal caregiver to enroll a child in daycare or pre-school. The informal authorization may also prevent the caregiver from consenting to extracurricular school activities, although this varies from school to school.

Obtaining legal guardianship can be a two-part process depending on the urgency and need of the guardianship order. Temporary legal guardianship and permanent legal guardianship are similar in that they both allow a person to make important decisions about the well-being of a minor. Both processes must have court approval. Temporary legal guardianship can be granted by the court on shortened notice in emergency situations to get a temporary order pending a full hearing on the formal legal guardianship proceedings. In order to file for a temporary emergency guardianship order, a petition for appointment of legal guardianship must have already been filed in the case. The filing of a temporary guardianship and permanent legal guardianship are typically filed at the same time.

Guardianship Authorization or Power of Attorney

Guardianship Power of Attorney: A guardianship power of attorney is one of the alternatives to guardianship that gives another person (the attorney-in-fact) legal powers and authorization to make decisions for a minor. More importantly, this document can put specific limitations and boundaries on the actions of the attorney-in-fact. For example, the guardianship power of attorney document can allow the attorney-in-fact to make health care, educational, and other decisions on behalf of their children on a temporary basis.

Caregiver Authorization: This type of authorization affidavit allows a relative of the child to enroll him/her in school without that person being legally appointed by a court as the child’s legal guardian. For example, the person also can make medical decisions for the child. As one of the alternatives to guardianship, a child’s non-relatives can also sign an affidavit, but their right to make decisions for the child’s medical care will be restricted. For instance, non-relatives are only authorized to make medical care decisions that are school related. Keep in mind, the Caregiver’s Authorization Affidavit is not a court document and can be canceled by either parent at any time. Furthermore, the caregiver must promptly notify the school if he/she is no longer acting in such a role.

    (c) If the person appointed as personal representative fails to give the required bond, letters shall not be issued. If the person appointed as personal representative fails to give a new, additional, or supplemental bond, or to substitute a sufficient surety, under court order, the person may be removed from office.

Probate Code 8482: The court in its discretion may fix the amount of the bond, but the amount of the bond shall be not more than the sum of:

    (1) The estimated value of the personal property.
    (2) The probable annual gross income of the estate.
    (3) If independent administration is granted as to real property, the estimated value of the decedent’s interest in the real property.

    (c) If the bond is given by personal sureties, the amount of the bond shall be twice the amount fixed by the court under subdivision (a).
    (d) Before confirming a sale of real property the court shall require such additional bond as may be proper, not exceeding the maximum requirements of this section, treating the expected proceeds of the sale as personal property.

    Ex Parte Petition
In California guardianship, an ex parte emergency petition is a request for a court order to appoint a temporary guardian or take other urgent action for a minor without the usual advance notice to all parties. It is used in emergencies where a child's health, safety, or welfare is in immediate danger, such as from abuse, neglect, or a parent's inability to provide care. The court may grant such orders when waiting for the standard legal process would result in irreparable harm.

Understanding the Mandatory Notices and Contract

Starting January 1, 2000, California passed a law that allowed non-attorneys to help people prepare common legal documents for the first time in history. Attorneys were not happy about this law and worked hard to make it as "restrictive" as possible, hoping it would fail and prevent consumers from accessing affordable legal services. Thanks to the efforts of CALDA, the California Association of Legal Document Assistants, the law remained in place, allowing legal document assistants in California to provide professional and affordable legal document preparation services.

The notices and contract we use are required by California law. All legal document assistants must provide these notices and use the mandatory contract set by the California Department of Consumer Affairs. While these notices and contracts may seem "restrictive" at first, Probate & More has been able to provide high-quality, professional legal document preparation services by creatively using legal software and materials approved by attorneys, all while staying within the law.
