How to File Conservatorship in Orange County
Last Updated: September 8, 2026
In this Article:
A complete guide to Orange County Superior Court conservatorship and the conservatorship process — forms, filing, Probate Notes, court investigators, costs, and how Probate & More can help.
Protecting a vulnerable adult in your family takes courage — and preparation. As a result, families who understand the Orange County conservatorship process before they file move through it faster, with fewer delays and less stress.
Orange County’s Probate/Mental Health Unit processes a high volume of conservatorship cases each year. In addition, the court expects every petition to be complete. As a result, one missing form or overlooked deadline can push a hearing back by months.
What to Know Before Filing in Orange County
For that reason, this guide walks you through the full process. It covers choosing the right type of conservatorship, filing at the Costa Mesa Justice Complex, completing the mandatory orientation, working with the Probate Court Services investigator, monitoring Probate Notes, and receiving Letters of Conservatorship.
Before you file conservatorship in Orange County, you may also find our California Conservatorship Guide helpful for a full statewide overview of the process.
Finally, Probate & More is a California Registered Legal Document Assistant (LDA). We prepare Orange County Superior Court conservatorship documents for families, and our conservatorship services cover all 58 California counties. We are not a law firm and do not give legal advice.
CONSERVATORSHIP OF THE PERSON
The conservator makes decisions about where the conservatee lives, what medical care they receive, and how their day-to-day personal needs are met.
CONSERVATORSHIP OF THE ESTATE
The conservator takes responsibility for the conservatee’s financial life — income, bills, assets, bank accounts, and property management.
PERSON & ESTATE COMBINED
A dual appointment giving the conservator full authority over both personal care decisions and financial management — the broadest form of court-granted authority.
By contrast, a Limited Conservatorship applies only to adults with developmental disabilities. The court tailors the conservator’s authority to each conservatee’s specific needs — leaving as many rights intact as possible.

Is the Orange County Conservatorship Process the Right Option?
Before you file conservatorship in Orange County, the court will want to know you explored every other option. For example, a judge may ask whether voluntary tools were put in place while the person still had legal capacity.
However, if those tools were never created, or if they no longer provide enough protection, conservatorship may be the right path forward.
Less Restrictive Alternatives to Consider First
- Durable Power of Attorney — Authorizes a trusted person to handle financial decisions. It is only valid if the individual still has capacity when they sign it.
- Advance Health Care Directive — Names a healthcare agent for medical decisions. It does not address finances, housing, or daily care needs.
- Revocable Living Trust — Transfers asset management to a successor trustee without court involvement. It must be created and funded before capacity is lost.
- Representative Payee — Covers government benefit management only. It does not address personal care or broader financial matters.
Therefore, conservatorship becomes the appropriate step when voluntary planning tools were never created, when they have broken down, or when financial exploitation or a medical crisis requires immediate court authority.
Orange County Superior Court Probate Division Overview
All conservatorship petitions in Orange County are handled by the Probate/Mental Health Unit of the Superior Court of California, County of Orange. This unit oversees conservatorships, guardianships, decedent estates, elder abuse matters, and minor’s compromise proceedings — all centralized at the Costa Mesa Justice Complex.
For example, every petitioner in Orange County — regardless of which city they or the proposed conservatee live in — files at the same location. There is no regional filing option. All documents, hearings, and clerk services flow through the Costa Mesa Justice Complex at 3390 Harbor Blvd., Costa Mesa, CA 92626.
Before scheduling a hearing, the court reviews each petition thoroughly. Filings with missing forms, incorrect service documentation, or incomplete medical declarations are flagged by the probate examiner — and that means delays. Accuracy from the first filing is the most direct path to a timely hearing.

How to File Conservatorship in Orange County — Step by Step
Each step below must be completed in sequence. Skipping a step or missing a court deadline gives the probate examiner grounds to flag your filing and push your hearing to a later date.
Steps 1–5: Petition, Filing, and Notice
Prepare Your Petition Packet
Assemble all required Judicial Council GC-series forms and Orange County local forms. Every field must be completed correctly — the probate examiner reads your entire packet before your hearing.
File at the Probate Clerk’s Office or via eFiling
Deliver your petition packet to the Probate Clerk’s Office, 1st Floor, Costa Mesa Justice Complex — or submit through an approved Electronic Filing Service Provider. At that point, pay the required fee.
Receive Your Case Number and Hearing Date
Next, the clerk stamps your documents, assigns a case number, and sets your hearing date. Write down your service deadlines right away — missing them can result in a continued hearing.
Serve the Citation on the Proposed Conservatee
After filing, state law requires personal service of Citation GC-320 directly on the proposed conservatee. Importantly, a person who is not a party to the case must complete this service. File your proof of service with the court.
Notify Required Relatives by Mail
In addition, mail written notice to the proposed conservatee’s spouse or domestic partner, parents, siblings, and adult children within the required timeframe. Then, file completed proofs of service before your hearing.
Steps 6–10: Orientation Through Appointment
Complete the Conservatorship Orientation Online
Under Orange County procedures, every proposed conservator to finish an online orientation course before the court signs the Order or issues Letters of Conservatorship. Afterward, upload your completion certificate to the case file. This step is non-negotiable — the court will not move forward without it. Available in 7 languages at occourts.org.
Cooperate with the Probate Court Services Investigator
Meanwhile, filing your petition automatically triggers an investigation by Orange County Probate Court Services. An investigator will reach out to schedule interviews. Therefore, respond promptly and have your documentation ready.
Monitor Your Probate Notes
Next, sign up for instant text or email alerts at pennotification.occourts.org. Search your notes at ocscefm1.occourts.org. Most importantly, clear every examiner issue before your hearing date — unresolved notes mean a continuance.
Attend Your Hearing at Costa Mesa Justice Complex
Then, appear in your assigned probate department on your hearing date. At the hearing, the judge evaluates your petition together with the investigator’s report. As a result, a complete, uncontested petition typically results in the Order being signed that day.
Receive Letters of Conservatorship (GC-350)
Finally, after the Order is signed, the court issues Letters of Conservatorship — the document that gives you legal authority to act. For person conservatorships, submit your completed Care Plan to the court as well.
Ex Parte Conservatorship Applications in Orange County
When a genuine emergency threatens the proposed conservatee’s safety or estate, you may request a temporary conservatorship through an ex parte application. However, Orange County applies strict rules to these filings. Consequently, mistakes can lead to denial or rescheduling.
Key Orange County Ex Parte Rules
- The general conservatorship petition must be filed first or at the same time as the ex parte application.
- Select filing type “Probate – XP” when submitting through the eFiling system.
- Orange County decides ex parte matters on the papers. The court rules in chambers, so no in-person or remote appearance is permitted.
- The court sends its ruling electronically or by U.S. mail based on your filing method.
- File and serve no later than 10:00 a.m. the day before the hearing date. Late submissions move to the next court day.
- Applications may not exceed 10 pages. Applications longer than 5 pages must begin with a statement of the relief sought and the grounds for it.
- Every exhibit and attachment must include electronic bookmarks. Otherwise, the court may reject filings that arrive without them.
- Email-only notice does not satisfy service requirements unless the receiving party filed written consent to email notice with the court.
Temporary Conservatorship Notice Requirements
- Personally serve Notice of Hearing (GC-020) on the proposed conservatee at least 5 court days before the hearing date, together with a copy of the petition.
- The ex parte hearing is typically scheduled one week after submission.
- To shorten or waive the 5-day notice period, file a separate declaration that explains the immediate and substantial harm that would occur during the notice period, under California Rules of Court, rule 7.1062.
Orange County Conservatorship Forms — Required Checklist
Specifically, a conservatorship petition in Orange County draws from two separate form libraries — statewide Judicial Council forms that apply in every California county, and Orange County local forms that this court requires in addition. Therefore, a single missing form is enough for the probate examiner to issue a deficiency note and delay your hearing.

Electronic Filing Requirements in Orange County
Generally, Orange County supports and encourages electronic filing for all probate and mental health matters. Understanding the court’s specific eFiling standards before you submit helps you avoid rejections and unnecessary delays.
WHO CAN E-FILE
For example, both represented parties and self-represented petitioners may use eFiling for Orange County conservatorship matters. Submit through an approved Electronic Filing Service Provider (EFSP). In-person filing at the 1st floor clerk’s window remains available during business hours.
BOOKMARKING REQUIRED
Importantly, electronic bookmarks are mandatory for all attachments and exhibits. Each reference to a specific section, page, or exhibit requires its own distinct bookmark. Depending on the circumstances, the court may reject submissions that arrive without properly bookmarked attachments — a rejection that resets your filing timeline.
FEE PAYMENT PORTAL
Finally, pay your filing fees online through OC’s dedicated Probate Fee Payment Portal at occourtsapp.occourts.org/aci/search. For the full list of approved EFSPs and current eFiling guidelines, visit occourts.org/online-services/efiling/efiling-probate-mental-health.
The Conservatorship Orientation — An Orange County Requirement
Orange County requires every proposed conservator to complete an online orientation course before the court will sign the Order Appointing Conservator or issue Letters of Conservatorship. This requirement applies in every general conservatorship case.
Therefore, court staff verify completion before releasing your documents.
Four Steps You Must Complete
- Access the online Conservatorship Orientation through occourts.org/divisions/probate. The course is available in 7 languages.
- Work through the full course. It covers your legal duties, financial responsibilities, and ongoing reporting obligations as a conservator.
- Download your certificate of completion at the end of the course.
- Upload the certificate directly to your case file. Also file GC-348 — Duties of Conservator and Acknowledgment of Receipt of Handbook for Conservators.
Therefore, complete this step as early as possible. Waiting until the week before your hearing risks a last-minute technical issue that delays your Letters.

Court Investigator Expectations in Orange County
Submitting your petition automatically opens an investigation file with Orange County Probate Court Services — a dedicated unit that handles all conservatorship and guardianship investigations for the county. Meanwhile, the investigation runs parallel to the rest of your case and must be completed before your hearing.
What the Orange County Probate Court Services Investigator Does
First, the investigator schedules a private meeting with the proposed conservatee. Their purpose is to determine whether the person understands what a conservatorship means, whether they support or oppose it, and whether their living circumstances and medical condition genuinely call for court-supervised protection. In addition, the investigator evaluates your suitability as the proposed conservator — looking for signs of any conflict of interest or capacity concerns. Ultimately, their written findings go directly to the judge and carry significant weight in the final ruling.
For that reason, treat the investigator as a neutral professional doing an important job. In addition, answer questions honestly, stay organized, and make it easy for them to complete their work on schedule.
Orange County Unique — Ongoing Review Schedule under Probate Code §1850:
• 6 months after appointment
• 1 year after appointment
• Annually thereafter — General conservatorships
• Every 2 years — Limited conservatorships
Orange County Unique — Adult Protective Services Coordination:
When a conservatee is also the subject of elder or dependent adult abuse, Orange County APS and Probate Court Services coordinate their investigations. Orange County APS 24-hour hotline: (800) 451-5155.

Orange County Tip: Be specific about why less restrictive options will not adequately protect this person. A clear, factual explanation helps the investigator write an accurate report for the judge.
Probate Notes and Common Delays in Orange County
After you file, an Orange County probate examiner reviews your entire petition before your hearing date. Specifically, the examiner looks for missing forms, service errors, incomplete declarations, and anything else that does not meet the court’s standards. If they find a problem, they list it in a Probate Notes memo. Therefore, your job is to fix every item on that list — or your hearing will be pushed to a later date.
If you are unfamiliar with how Probate Notes work, we explain the process in detail in our guide, Understanding Probate Examiner Notes in California. Nevertheless, although that article focuses on probate estates, Orange County Superior Court uses the same Probate Notes review system for conservatorship cases.

Cost of Conservatorship in Orange County
Overall, the total cost to file conservatorship in Orange County depends on the type of conservatorship, the value of the conservatee’s estate, and whether you retain an attorney, work with an LDA, or represent yourself.
Court Filing Fees
Because fees change periodically, confirm the current initial petition filing fee before filing. Confirm the current amount at occourts.org/forms-filing/fee-schedule before you go to the clerk’s window.
In addition, subsequent filings, including inventories, accountings, and supplemental petitions, each carry their own fees. Petitioners who qualify financially may request a fee waiver using Form FW-001.
Probate Court Services Investigation Fees
Orange County charges a separate investigation fee for the initial interview and for each periodic review after appointment. Generally, when the conservatee has available assets, these fees are paid from the estate.
However, if the estate has no liquid assets, the conservator pays personally. Qualifying petitioners may request a fee waiver before the investigation.
Bond Premiums
When the court grants estate powers, it typically requires a surety bond to protect the conservatee’s assets. As a result, bond premiums are paid annually and increase with the value of the estate under management.
Attorney Fees vs. LDA Document Preparation
Full attorney representation in a conservatorship matter can cost several thousand dollars or more. A California Registered LDA prepares court forms at a significantly lower cost.
By contrast, LDA services cover document preparation only. They do not include legal advice, courtroom representation, or legal strategy.
